Legislation: Legal Practice Council begins work this week

A presidential proclamation gazetted yesterday has confirmed that the South African Legal Practice Council will officially begin its work on Thursday. Most chapters of the 2014 Legal Practice Act will be effective the following day – with the notable exception of those dealing with the legal services ombud, the Legal Practitioners’ Fidelity Fund and provisions affecting trust monies. While a commencement date has yet to be announced for several sections of Chapter 3 (regulating legal and candidate legal practitioners), sub-section 35(6) – allowing the Minister to determine the ‘maximum tariffs payable to legal practitioners … instructed by any state department or provincial or local government in any matter’ – will be effective from Friday.
